Dimissioni del contratto di lavoro a tempo determinato
"Nel rapporto di lavoro a tempo determinato il contratto ha una durata limitata nel tempo. Ai sensi dell’art. 2119 c.c. tale tipologia di contratti non è soggetta al regime della libera recedibilità.
Pertanto il dipendente non può rassegnare le proprie dimissioni prima della naturale estinzione del vincolo contrattuale."
Il contratto di lavoro a tempo determinato ha una durata limitata. All'estinzione della data il contratto di lavoro si estinuge. Ai sensi dell'articolo 2119 del Codice Civile questa tipologia di contratti non è soggetta alla libera recedibilità, pertanto il dipendente non può rassegnare le proprie dimissioni prima della naturale estinzione del vincolo contrattuale.
"Unica eccezione al principio è rappresentata dalla sussistenza di una giusta causa di recesso (sul concetto di giusta causa vedi l'articolo "Giusta causa"), nel qual caso il lavoratore avrà diritto al risarcimento del danno suscettibile di essere rapportato, secondo quanto si legge in alcune pronunzie (Cass. 3 febbraio 1996, n. 924), alle somme che avrebbe percepito se il contratto di lavoro avesse avuto la durata prevista. È fatta salva in ogni caso la prova, da parte del datore di lavoro, che il dipendente dimissionario abbia comunque svolto altra attività lavorativa percependo le relative retribuzioni (Cass. n. 924 citata)."
La libera recessione dal contratto è prevista solo nel caso in cui sussista la giusta causa. In questo caso, secondo la Cassazione 3 febbraio 1996, n. 924, il dimissionario ha diritto ad un risarcimento, pari alle somme che avrebbe percepito se il contratto di lavoro avesse avuto al durata prevista. Inoltre, è fatta salva in ogni caso la prova, da parte del datore di lavoro, che il dipendente dimissionario abbia comunque svolto altra attività lavorativa percependo le relative retribuzioni.
"In difetto di giusta causa, il lavoratore dimissionario, in quanto parte inadempiente del rapporto contrattuale, sarà tenuto al risarcimento dei danni subiti dal datore di lavoro (Cass. 23 dicembre 1992, n. 13597)."
Secondo la Cassazione 23 dicembre 1992, n. 13597, in difetto di giusta causa il dimissionario dovrà risarcire il datore di lavoro.
